Clorox ® Hockey Mask Rules (the “Competition”)

Full Competition Rules and Regulations

Please read these competition rules (“Competition Rules”) in their entirety before entering the Competition. Do not enter the Competition unless you agree to these Competition Rules. Participation in the Competition constitutes unconditional agreement and acceptance of these Competition Rules which are final on all matters relating to the Competition. By entering this Competition you agree to be bound by the decisions of contest judges which are final and binding in all respects.

1.  

COMPETITION PERIOD: The Competition runs from 12:01 am ET on November 1, 2011 to 11:59 pm ET January 8, 2012 (the “Competition Period”). This competition is sponsored by the Clorox Company of Canada, Ltd. (“Sponsor”).

2.  

ELIGIBILITY: This competition is open to legal residents of Canada that have reached the age of majority in the province they reside upon the start of the Competition Period. Employees of the Sponsor, its agents, advertising or promotional agencies or the independent contest organization and those with whom they are domiciled are not eligible.

3.  

HOW TO ENTER: NO PURCHASE NECESSARY. To enter the Competition, you must create a design for the hockey mask of Carey Price*; goalie of the Montreal Canadians. You can create and enter as many hockey mask designs as you wish. Each design will constitute one (1) entry into the Competition (each an “Entry”).

There are three (3) ways to submit your Entry that will be accepted by the judging panel:

1: Go to www.blanchissage.ca follow the links and use the on-line design tool to create your design. Submit your design along with a completed entry form available on the website.

2: Using your own graphic design program, go to www.clorox.ca/promotions and download the mask design template. Certain graphic design programs may not be compatible with the mask design template. Create your own graphic design using the template provided, then return to www.blanchissage.ca and upload your Entry and complete the entry form available on the website.

3: Go to www.blanchissage.ca to download a mask design template and hand draw your design(s). Then scan and follow the links to upload the Entry to www.blanchissage.ca along with a completed entry form available on the website OR mail the Entry to P.O. Box 250-Clorox, Pickering, Ontario L1V 2R4 along with your name, home address and phone number. Mailed entries must be received by the Sponsor no later than January 5, 2012 to be eligible. Please allow sufficient time for Canada Post to deliver your Entry.

Competitors are not permitted to use images or logos that are either trademarked or copy-write protected. Entries containing trademarked or copy-write images or logos may be voided and not judged. The team logo(s) of the Montreal Canadiens may be incorporated into the design, but remains the property of the Montreal Canadiens.



All Entries will be reviewed by the Screening Panel which will consist of 3-5 judges including David Arrigo (the Mask Painter), plus representatives from the Canadien Hockey Club and Clorox. The Screening Panel will select three (3) finalists for Carey Price’s hockey mask (the “Finalist Entries”). Finalist Entries will be chosen based on those that best embody the excitement and spirit of hockey in Montreal. The Screening Panel will select the Finalist Entries during the week of January 9, 2012. Starting January 16, 2012 at noon ET consumers can go to www.blanchissage.ca and vote for the finalist design that best embodies the excitement and spirit of hockey in Montreal. Voting is limited to one vote per day per unique email address. Voting will end at noon ET on January 27, 2012. The Carey Price design securing the most votes, respectively, will be declared the winner.

ODDS OF WINNING: Odds of winning will depend on the number of eligible entries received and the creative quality of the designs.

4.  

PRIZE: One (1) Prize will be awarded consisting of two tickets to Montreal Canadiens vs. Toronto Maple Leafs Hockey game in Montreal March 3, 2012**, at which time Carey Price* will wear the winners design on his goalie mask. After the hockey game, the winner will receive the autographed mask they designed for Carey Price* at a mutually convenient time and place. The winner and their travel companion will also have the opportunity to meet Carey Price* during their time in Montreal, schedule permitting, at a mutually convenient time and place. The approximate retail value of the Prize is $4,000. The Prize includes round trip economy airfare for two (2) adults from a major Canadian airport closest to the Prize winner’s place of residence in Canada to Montreal, ground transportation to and from the Dorval airport in an airport limousine, 2 nights accommodation in a four star (or better) hotel (based on one room, double occupancy), and $500 in spending money. If the winner resides within a reasonable distance of Montreal, ground transportation to the hotel will be provided.

The Prize winner and his/her traveling companion are solely responsible for all costs and expenses not expressly described herein as included as part of the prize, including, without limitation, applicable taxes, fuel, ground transportation to their local airport and any other ground transport not specified above, meals, merchandise, telephone calls, insurance together with any required travel, and all personal expenses of any kind or nature, together with any applicable costs of attending the hockey game. The winner and companion must attend the designated Montreal Canadiens hockey game. Failing to attend may result in the prize being forfeited, at the Sponsor’s sole discretion in accordance with the Competition Rules.

The Prize may not be sold or transferred and is/are not convertible to cash. Sponsor reserves the right to substitute the Prize in whole or in part in the event that all or any component of the Prize is unavailable in accordance with the Competition Rules. Any taxes and other incidental or other charges on prizes are the sole responsibility of the winner.

5.  

WINNER SELECTION: The winner will be selected based on the design receiving the most votes from the Finalist Entries as determined by the Screening Committee at noon ET on January 30, 2012 at The Takamatsu Group Inc, Toronto, Ontario, Canada. The selected winner will be notified within five (5) business days of selection by the Screening Committee. Before being declared a winner, the selected entrant (eligible according to the official Competition Rules) will be contacted by telephone or email and required to answer correctly, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question to be administered by the Sponsor at a mutually convenient time. Upon determination of the winner, he/she will be contacted by the Sponsor to make arrangements for the awarding of the Prize. Winner and his/her travel companion will be required to sign a standard Declaration of Compliance, Liability Release form and Publicity Release consenting to the use of his/her name, city or province and/or photograph, without further compensation, in any publicity carried out by the Sponsor and/or its advertising and promotional agencies relative to his/her participation in the Competition.

 

If the selected entrant (a) cannot be reached by email and/or telephone within five (5) business days from the first attempt to contact him/her by the Sponsor, (b) fails to correctly answer the skill testing question, (c) fails to return the properly executed Declaration of Compliance, Liability Release form and Publicity Release within the specified time or (d) is unable to attend the designated Montreal Canadiens hockey game as determined at the Sponsor’s sole discretion, then he/she will be disqualified and another winner will be selected in accordance with the selection process as stated in the Competition Rules based on the number of votes received during the contest period. The Sponsor will not be responsible for failed attempts to contact a selected winner.

6.  

CONSENT TO MARKET TO ENTRANTS: By entering the Competition, each entrant permits the Sponsor, its agents, promotional agencies, representatives and judges to collect the information submitted with your entry and to use it for the purpose of administering the Competition and the Prize, including any publicity carried out by the Sponsor and/or its advertising and promotional agencies related to the Competition. Personal information collected from entrants will only be used by the Sponsor to administer the Contest and, where an entrant has so elected, to provide the entrants with information regarding upcoming events and/or promotions from the Sponsor (which entrants may unsubscribe from at any time). 7.

INTELLECTUAL PROPERTY: The Sponsor reserves the right to modify the Finalist Entries at its sole discretion. The entrants will be required to acknowledge that the Finalist Entries becomes the property of the Sponsor and can be reassigned or used at a later date without recognition or remuneration to the entrants. All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.

8.  

ADDITIONAL TERMS: All entries become the property of the Sponsor who assumes no responsibility for garbled, inaudible, lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions. Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, printing errors, postal delays, lost, delayed or garbled data or transmissions, omission, interruption, deletion, effect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void.

In the event of a dispute over email/online entries, the winner will be deemed to be the holder of the winning email account. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access or online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.

Entrants and/or winners assume liability for injuries caused, or claimed to be caused by participating in the Competition, by the acceptance, possession, or use of any prize awarded, including but not limited to claims/damages for personal injury, or property damage.

In the event of any discrepancy or inconsistency between the terms and conditions of these Competition Rules and disclosures or other statements contained in any Competition-related materials, including, but not limited to: the Entry Form, and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control.

9.  

LIABILITY: By entering the Competition, each entrant hereby releases the Sponsor, the Montreal Canadiens, the National Hockey League, and its member teams, the NHL Players Association and each of their respective employees, directors, officers, governors, affiliates, representatives, parent companies, subsidiaries, professional advisors, and advertising and promotional agencies from any and all liability whatsoever, and waives any and all causes of action, related to any injuries, loss or damage of any kind to any person or persons (including, without limitation, death or personal injuries, property damage, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional) resulting in whole or in part, directly or indirectly, from acceptance, possession, use and misuse of, and inability to use, any prize or any part of any prize or otherwise related to participation in the Competition.

10.  

TERMINATION/MODIFICATION: If for any reason, in the opinion of the Sponsor in its sole discretion, the Competition is not capable of running as originally planned, or if the administration, security, fairness, integrity or the property conduct of the Competition is corrupted or adversely affected, including but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes, the Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux (“Régie”) in the province of Québec, to cancel, terminate, modify, amend, extend or suspend the Competition in whole or in part, including, without limitation, canceling any method of entry, and/or selecting a winner from previously received eligible entries. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Competition or to be acting in violation of the Competition Rules or otherwise in a disruptive manner. Any attempts to deliberately damage any website or to undermine the legitimate operation of this Competition is a violation of criminal and civil laws and should such attempt be made the Sponsor reserves its right to seek remedies and damages to the fullest extent of the law. The Sponsor shall not be held responsible for any errors or negligence that may arise or occur in connection with the Competition including any damage to an entrant’s computer equipment, system software or any combination thereof, as a result of their participation in this Competition or from downloading any material from the Competition website, where applicable.

The Sponsor reserves the right, at its sole discretion and with the consent of the Regie, to substitute the Prize or portion thereof with (a) prize(s) of equivalent or greater value for any reason and without liability.

The Sponsor does not warrant that access to or use of the Competition will be uninterrupted or error-free.

11.  

FOR RESIDENTS OF QUÉBEC: Any litigation in regards to the conduct or organization of this publicity competition may be submitted to the Régie for a ruling. Any litigation in regards to the awarding of the prize may be submitted to the Régie, only for purposes of helping the parties reach a settlement.

In the event of any discrepancies between the English language rules and the non-English language rules, the English rules shall prevail.

12.  

CONSTRUCTION: Any litigation must be commenced in the City of Toronto, Ontario. All issues and questions concerning the construction, validity, interpretation and enforceability of these official Competition Rules, or the rights and obligations of entrant and Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.

13.  

This Competition is subject to all Federal, Provincial and Municipal laws and regulations applicable in the province of Quebec.

*At the time of the writing of the Rules & Regulations, Carey Price is the “starting” goalie of the Montreal Canadiens. If at any time Carey Price is unable to be the “starting” goal tender, or for any reason is unable to wear the mask, his replacement, as designated by the appropriate team, may wear the winning design at an appropriate time. If Carey Price is traded, the Sponsor will make every reasonable effort to arrange for Carey Price to wear the winners mask design with their new team, using, if applicable, the new teams’ logo. If for any reason Carey Price is unable to wear the mask during a game, the goalie in question will wear the mask in practice. Any modification to the Prize as described herein will be at the sole discretion of the Sponsor in accordance with these official Competition Rules.

** the sponsor reserves the right to select an alternate Montreal Canadiens home game for the winner and their guest to attend due to unforeseen circumstances.
